Denied
Boarding Rights
February 2004

Malta adopted the provisions of the Denied Boarding
Directive as part of the acquis communautaire. This
Directive has recently been updated
[Link to Directive].
These regulations establish rules applicable where
passengers are denied access to an overbooked scheduled
flight for which they have a valid ticket and a confirmed
reservation.
As a user of air transport, you may already have been
affected by the consequences of overbooking. The local
regulations which define your rights as a passenger are
listed in LN 78 of 2001. However, we realized that few
people knew about these rights if they are denied
boarding.
In January of this year we wrote to the Director of Civil
Aviation where we showed our concern about the apparent
failure of the competent agencies in Malta to adequately
inform passengers of their rights when they are denied
boarding on a flight on which they were booked.
We also asked that visible notices are to be easily
accessible to passengers at the check-in counters or
boarding gates informing passengers of their basic
rights.
We are satisfied that the authorities have for some time
now put up such notices at the check-in counters
